Agreement to Terms

By downloading, installing, or using the FishFrame mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MemoryForge, LLC ("we," "us," or "our") regarding your use of FishFrame.

You agree to use the App in compliance with all applicable laws
We reserve the right to modify these Terms at any time

2. Description of Service

FishFrame is a mobile application for iOS devices that allows users to:

Log fishing trips with photos, locations, and catch details
Manage tackle box inventory and bait catalog
View fishing conditions (weather, tides) for logged trips
Analyze fishing statistics and patterns
Export fishing data

Service Tiers

Free: Basic trip logging with limited features
Pro: Unlimited trips, advanced analytics, data export ($4.99/mo or $49.99/yr)
Elite: All Pro features plus premium content ($14.99/mo or $119.99/yr)
Lifetime: One-time purchase of Pro features forever ($199.99)

3. User Accounts and Subscriptions

3.1 Subscription Terms

Subscriptions are billed through Apple's App Store
You will be charged the subscription price at the time of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
Subscriptions can be managed and canceled in iOS Settings → Apple ID → Subscriptions

3.2 Free Trial

New subscribers may be eligible for a 7-day free trial
You will not be charged during the trial period
Cancel anytime during the trial to avoid charges
If you do not cancel, you will be charged the subscription price at the end of the trial
Free trial is available once per user

3.3 Refunds

Apple's Refund Policy Applies:

All purchases are processed through Apple's App Store
Refund requests must be submitted to Apple at reportaproblem.apple.com
We cannot process refunds directly

4. Use of the App

4.1 Permitted Use

You may use FishFrame for personal, non-commercial purposes to log your fishing trips, manage tackle, and view fishing conditions.

4.2 Prohibited Use

You may NOT:

❌ Use the App for any illegal activity
❌ Reverse engineer, decompile, or disassemble the App
❌ Attempt to bypass subscription or feature restrictions
❌ Use the App to harass, abuse, or harm others
❌ Upload malicious code or viruses
❌ Circumvent security features

5. User Content

Ownership: You retain all rights to content you create in the App (photos, notes, catch logs). We do not claim ownership of your content.

Local Storage: Your content is stored locally on your device. We do not have access to your content unless you explicitly share it with us.

Responsibility: You are responsible for backing up your data and ensuring you have rights to any photos you import.

6. Intellectual Property

FishFrame, including all code, design, graphics, text, and functionality, is owned by MemoryForge, LLC and protected by copyright and trademark laws.

We grant you a limited, non-exclusive, non-transferable license to install and use the App on devices you own or control.

7. Third-Party Services

FishFrame integrates with third-party services:

Apple Services: Geocoding, WeatherKit, StoreKit
NOAA API: Tide and water level data (public service)
Mapbox: Map tiles for offline viewing
RevenueCat: Subscription management (optional)

Important: We are not responsible for third-party services. Their availability and accuracy is outside our control.

8. Disclaimers and Limitations of Liability

FishFrame provides weather and tide information for informational purposes only. This information:

May not be accurate, current, or complete
Should NOT be relied upon for safety decisions
Is not a substitute for professional weather forecasts or marine advisories

You are responsible for:

Checking official weather forecasts before fishing
Following local boating and fishing safety regulations
Using appropriate safety equipment (life jackets, etc.)

8.1 "AS IS" Disclaimer

FishFrame is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do NOT guarantee:

The App will be error-free or uninterrupted
Defects will be corrected
Weather, tide, or location data is accurate

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MemoryForge, LLC shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, personal injury, or property damage.

Maximum Liability: Our total liability shall not exceed the amount you paid in the 12 months prior to the claim, or $100 USD, whichever is less.

9. Termination

You may stop using the App at any time by deleting it from your device and canceling your subscription in iOS Settings.

We may terminate your access if you violate these Terms.

10. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted in the App or on our website.

Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States.

Mandatory Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration (except small claims under $10,000).

Class Action Waiver: You agree to arbitrate disputes on an individual basis only. No class actions are permitted.
